1. Platform Overview & Nature of Service

Sellary (referred to herein as "we," "us," or "our") operates as a digital marketplace infrastructure, empowering creators to distribute and monetize digital products. We provision the technological framework required for product listing, secure payment processing, and instantaneous digital fulfillment.

Intermediary Status: Sellary strictly acts as a technological intermediary connecting creators with buyers. We are not a direct party to the contractual agreement formed between the buyer and the creator. Creators bear absolute responsibility for the quality, legality, and comprehensive customer support of their respective products.

Sellary charges a 10% total fee (or a minimum of ₹5, whichever is higher) on all successful transactions:

3. Creator Responsibilities

By registering as a creator on Sellary, you expressly warrant and agree to:

• Possess the absolute legal right, title, and authority to distribute all uploaded content.
• Furnish accurate, transparent, and non-misleading product representations.
• Deliver high-quality digital goods that strictly conform to their advertised descriptions.
• Maintain prompt and professional correspondence regarding buyer inquiries.
• Comply comprehensively with all applicable local, national, and international laws.
• Abide strictly by our Acceptable Use and Content Policies outlined herein.

Intellectual Property Rights: You retain absolute ownership over your intellectual property. By utilizing our infrastructure, you grant Sellary a worldwide, non-exclusive, royalty-free license to host, display, distribute, and functionally process your products strictly for the facilitation of your sales.

4. Content Policy

The following content is strictly prohibited:

Products containing prohibited content will be flagged for review and may be blocked. Repeated violations will result in account termination.

5. Third-Party Integrations

• Authentication: You may sign in using third-party services like Google (Firebase). By doing so, you agree to their respective terms.
• Telegram: Monetizing Telegram groups involves using our Telegram bot. You must adhere to Telegram's Terms of Service.
• Payments: All transactions are securely processed via Razorpay.

6. Buyer Rights

• Access to purchased products as described
• Secure payment processing via Razorpay
• Instant digital delivery after payment
• Refunds as per our Refund Policy
• Customer support for delivery issues

6. Payment & Payouts

• All payments are processed securely through Razorpay
• Creator payouts are processed weekly (minimum ₹500)
• Payouts are sent to your registered bank account or UPI
• Sellary may hold payouts if suspicious activity is detected

7. Account Termination

We may suspend or terminate accounts that:

• Violate these terms or content policies
• Engage in fraudulent activities
• Receive multiple buyer complaints
• Provide false information
• Attempt to circumvent platform fees

Upon termination, pending payouts may be withheld pending investigation.

8. Limitation of Liability

Sellary acts as an intermediary and is not responsible for:

• Quality or accuracy of creator products
• Disputes between creators and buyers
• Third-party content linked from products
• Technical issues beyond our control

Our liability is limited to the platform fees collected per transaction.

9. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.

10. Changes to Terms

We may update these terms periodically. Significant changes will be notified via email or platform notification 30 days in advance. Continued use after changes constitutes acceptance.
